What is the Franchise Fee? The Franchise Fee is set at 5% of the cable companys gross revenues, as defined in the Franchise Agreement.
What is the PEG Fee? Public, Educational, and Government (PEG) Access programming is supported by the PEG Fee that is assessed to each cable subscriber. According to state law, these funds must be used only for the production of PEG Access programming.
What can the City, or Franchise Authority, do to prevent the cable company from raising rates? The City's overview of rates is limited to the basic cable service tier, which includes the retransmission of local television broadcast signals and the public, educational, and governmental (PEG) access programming. Rate regulation over the other tiers containing the vast majority of cable channels was removed from local jurisdiction as part of the 1996 Federal Telecommunications Act. The Federal Communications Commission (FCC) provides a form for the cable companies to calculate the allowed rate for the basic service tier. Rates for other tiers are not regulated. The City can challenge whether the company correctly calculated the allowed rate.
Why cant the
Cable Coordinator assist subscribers with complaints about cable modem
Internet service? In 2003, the FCC made a Declaratory Ruling that
reclassified Internet over cable as an information, not video, service.
As the city only has authority over cable video service, this decision
removed jurisdiction over cable modems from the local Franchise Authority.
In addition, the decision eliminated the payment of franchise fees for
cable modem service. As the FCC now has juridiction over cable modem service,
all complaints regarding this service should be adressed to the FCC.
